Terms & Conditions

Responsibility of Tour Company

Morgan Tours acts as intermediary and/or agent in selling services, or in accepting reservations or bookings for services not directly supplied by our travel agency. These services are listed in our Destinations Planner and may include any transportation, accommodation, meals, guides, tours, performance tickets, etc. required to complete the tour itinerary. All services are subject to the applicable tariffs, terms and conditions under which they were contracted. We choose our suppliers carefully, but we cannot directly control them. Therefore, Morgan Tours shall not be liable or responsible for breach of contract or intentional or careless actions or omissions on the part of such suppliers, which result in loss of service, damage, delay or injury to you or your travel companions or group members. Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice or reservation, we do not guarantee such suppliers' rates, bookings or reservations, including rates of exchange.

Morgan Tours is not to be held liable or responsible, under any circumstances, for injuries, damages or losses caused to a traveler in connection with any accident, sickness or ill-health including physical, psychological or other personal stresses (real or apprehended), social or labour unrest, terrorist activities, war, local laws, climatic conditions, abnormal conditions or developments, or any actions, omission or conditions that may impact the itinerary. Morgan Tours reserves the right to withdraw a tour, to refuse to accept or retain anyone as a tour member at any time, or to make reasonable changes in the itinerary, routing, hotels, sightseeing, performances or any part of the program. These changes would occur whenever Morgan Tours deems such behaviour, conduct or conditions advisable for the comfort, enjoyment, safety or convenience of tour members, or the smooth operation of the tour, or if such changes result from circumstances beyond the control of the company.

Responsibility of Traveller

By embarking on a tour program, the traveler voluntarily assumes all risks involved with such travel, expected or unexpected. The traveler is hereby warned of such risks and is advised to obtain appropriate insurance coverage (see Insurance). Checked baggage and hand luggage is at the owner's risk throughout the tour.

Each tour member is responsible for observing and respecting the laws, regulations and customs of each country visited. Tour members are asked to maintain courteous, pleasant and helpful attitudes and relationships within the tour group and to follow the directions of the tour leader in all circumstances pertaining to the tour itinerary.

When applying, please report any condition (allergies, special diet, etc.) requiring special consideration, attention or treatment. Physically challenged persons are welcome on our tours, but if special assistance or equipment is required, must be accompanied by a qualified companion who assumes total responsibility for this person's physical well-being. Required equipment (wheelchair, etc.) is the responsibility of the traveler and his/her companion.

We will do our utmost to make tour participation possible, however, we must reserve the right to exclude any participant whose need for care is beyond what can be reasonably provided within the normal operation of the tour.

Registration

Remittance of your deposit cheque or written or verbal authorization by the client to charge a credit card for a tour program shall constitute acceptance by the client of the Terms and Conditions Agreement herein, and indicates that the client has advised your traveling companion(s) or group members of the information herein. Any changes, alterations or deviations to any part of the tour agreement or itinerary must be made by the client in writing and confirmed by Morgan Tours.

Morgan Tours sends a receipt acknowledging the deposit and subsequent payments to each tour member after funds are received in our office and processed. Any changes, alterations or deviations are noted with this receipt. Once acceptance is confirmed, tour members are expected to attend the tour.

Payments
The respective deposit and payment schedule is detailed with each tour itinerary in the Destinations Planner and on the Web Site. Payment may be made in cash, by cheque (personal or certified), money order, bank wire or accepted credit card. Final payment is due before tour departure on the date stated in each specific tour itinerary. Payments may be made in Canadian, US or Euro dollars.

Credit Cards
Tour members may use Mastercard or Visa, following the schedule of payments listed for the individual tour. Visa and MasterCard are processed in US dollars. Any required exchange into another currency is made by your bank, according to the agreement it has with the credit card company. Exchange rates are beyond the control and responsibility of Morgan Tours. Your authorization of the use of your credit card binds you to the terms and conditions of the contract whether or not you have actually signed the draft. Verbal authorization of your credit card allows us to process your reservation at quoted costs, whether or not the applicant has submitted the Registration form, available from our office, on our website or at the back of the Destinations Planner.

Refunds
Requests for refunds must be made in writing. No refunds will be made due to airline delays or other acts beyond the control of Morgan Tours. No refunds will be made for unused services. Any refund request is subject to conditions outlined under Cancellation section of this document.

Itinerary Items
Information, itinerary and airline tickets (as applicable) will be sent approximately 21 days before departure if full payment has been received. Where payment or booking is late, we reserve the right to charge for overnight delivery. If late delivery results, we accept no responsibility for the consequences.

Tour Costs

Prices quoted are based on total costs and tariffs from all suppliers as of the date of publication of the Destinations Planner. If a supplier's costs change significantly, we reserve the right to adjust the quoted tour price. If as a result, the total tour cost increases by more than 10%, the registered tour member has the right to cancel without penalty, within 7 days of notification. This does not include re-costing due to any new taxes, charges or levies imposed by a government or its agencies, or any currency fluctuation or differences of rate of exchange. Any significant change may be reflected in the final tour balance, payable without right of cancellation.

Tour Modifications

Once registered for a tour, the company will endeavour to tailor a tour package to the tour member's specific needs, if modifications to the itinerary are requested. All requests must be received in writing for additional services and/or itinerary modification. It must be understood that individual modifications are time consuming and subject to an administrative charge. Tour costs will be modified to reflect these charges, plus any additional expenses such as charges for fax and telephone, messenger or postal services, cancellation of unused hotel space, airline or cruise alteration charges, in addition to the cost of the requested new services. There is no guarantee that special services requests will be available due to supplier limitations. Inability to obtain special services for whatever reason does not entitle the tour member to a refund or to cancel their tour participation, but rather to revert to the planned schedule of events as listed in the original tour itinerary.

Fees for performance tickets, guided tours and building entrances included in the original itinerary are not refundable. All special requests for itinerary modifications should be received in writing and are subject to availability. Tour deposit must be authorized and accepted before special services are booked.

Accomodation

Morgan Tours selects comfortable, first-class or equivalent hotels providing standard, twin bed, double-occupancy rooms (i.e., two people, two beds) with ensuite toilet and bath/shower. Other types of accommodation (king-size bed, suite, triple, etc.) will be arranged upon request, depending on the availability of such type of accommodation in the hotel in question. The additional charge for this service is dependent on individual hotel rates.

Single accommodation is available for a supplementary cost, detailed in each tour bulletin. It should be noted that, while single rooms will provide greater privacy, they are not necessarily the same size as the doubles, which contain two people. Often they are smaller (especially outside North America). This is beyond the control of Morgan Tours. Single accommodation should be requested upon registration.

Persons traveling individually but wishing to share a room may be accommodated. We will endeavour to assist in this regard, if requested to do so. While every effort is made to help find a suitable candidate, we assume no responsibility that a choice will be available or acceptable (to either or both parties). The onus is on the tour member to find a tour partner, or to accept a partner if one is available and suggested by the company. If no available or acceptable partner (to both the tour members) can be found, the single supplement is applied in full.

Insurance

We strongly recommend that all tour members consider supplementing insurance they may already carry with a comprehensive Travel Insurance policy. This is an individual choice, made directly with our recommended insurance company, or another insurance company of your choice.  We recommend to tour members two policies: one for Canadian and one for US and International tour members. Each policy covers trip cancellation, interruption, air and public conveyance delay or accident, baggage, medical insurance and emergency hospital. Coverage is only for services booked through Morgan Tours. Prices will vary according to clients' age and tour cost. For US and International tour members, we include an Insurance Application with each Tour Registration Confirmation that can be filled out and sent in directly to the Insurance provider at each tour member's discretion within 14 days of Registration. For Canadian tour members, Morgan Tours will assist with Insurance arrangements and requirements through our preferred Canadian supplier. This must be booked within seven days of Tour Registration. Coverage for Canadian tour members is also available, under certain circumstances, for pre-existing medical conditions. A questionnaire must be completed and submitted to the insurance company. Full detail on both insurance policies may be obtained through the Morgan Tours office and are listed on our website.  Insurance Company detail may change without notice.  Please check for the current coverage options and costs.

Cancellation Policy

Insured Clients
Insurance covers registered tour participants from the date of deposit until the date of return against medical circumstances including compassionate (immediate) family emergencies that would preclude participation in the tour. The total amount of the tour fees paid to the time of such notification is insured, less the insurance premium.

All cancellations must be received in writing from the registered tour member and full documentation must be provided to the insurance company according to their requirements. There is no guarantee that a claim will be settled favourably. Morgan Tours acts solely as the reporting agent and has no influence over any adjudication process used by the insurance company.

Non-Insured Clients
All cancellation notices must be received in writing from the registered tour member. The initial deposit is non-refundable. In addition, there is a charge of 50% of the remaining balance of the tour cost, if notification in writing is received over 60 days before departure. Within 60 days of the departure date, or once the final balance has been processed, the tour cost is non-refundable. The client may name a substitute, or Morgan Tours will attempt to re-sell the space after filling any un-booked places. Should the space be re-sold by the company, after filling all open tour places, or if the client finds a suitable replacement, the charge is $500 per person. Any tour member replacement must meet the requirements of Registration (Passport, Visa if required, etc), pay any outstanding Balance of Account (if applicable) and accept the Terms and Conditions as stated herein.

Performance Tickets

Opera, theatre, ballet, symphony and other entertainment events listed for individual tours are booked with suppliers, and reasonable assurance of ticket availability is received by the company before a tour is announced or published. Notwithstanding, such arrangements are subject to final availability from the suppliers. In exceptional cases, booked performances can be cancelled without due notice by the organizations concerned. In such a case, suitable alternatives, replacement venues and/or fee adjustments will be arranged. Casting details are subject to change by the various suppliers and are completely beyond the control of Morgan Tours. All rights pertaining to specific seat locations are retained by the supplier of the performances in question. Morgan Tours can influence the assignment of seats only according to price and general area selection. These are detailed for each tour.

Guided Tours

Morgan Tours retains the services of high-quality, professional, English-speaking guides for each sightseeing tour included on the itinerary. Transportation and entrance fees to museums and other buildings visited are included. Unless otherwise stated, tour groups are private (i.e., for our group only). Questions and dialogue pertaining to the tour itinerary are of course welcomed and encouraged by the guides as long as they do not unduly interrupt the program.

Meals

Group meals that are part of the final itinerary have a preset menu (often but not necessarily with several choices). Special concerns regarding diet, whether for medical or religious reasons or simply individual preference, must be stated in writing upon joining the tour. The numbers and types of meals to be included in the final itinerary are stated for each tour. Last minute dietary requests may not be accommodated.

Baggage

Tour members are expected to label all baggage items.  You may choose to use the Morgan Tours baggage tags provided, completed to show name, address and other particulars. For security, this label may be reversed to hide the information from view, but the owner's name must be written on the visible portion. This can be additional to any other baggage identification a tour member wishes to use.  The blue tags are helpful for identification by hotel baggage handling staff in the event we change hotels on the itinerary, as we move from city to city.

Most airlines have a limit of one piece of checked baggage (size restrictions apply) per person. Hand luggage is entirely under the owner's care at all times. Tour members are responsible for any excess baggage charges levied by airlines or other transportation suppliers.

The company will arrange for baggage transfer in to and out of hotels, conveyances, etc., unless otherwise stated, during the tour itinerary. It is the individual's responsibility to carry his/her baggage to and through Customs, airline and other security checkpoints. It should be noted that for security reasons, by law or by regulation, passengers are prohibited from transporting any property other than their own personal belongings.

Transportation

Land
Coaches used are high quality, clean and comfortable (with toilet where possible). Special seating is assigned on a first-come, first-served basis. Tour members with medical or mobility concerns have first priority. For extended itineraries, buses chartered will usually have extra seats for members to move about. Coaches are non-smoking and, unless otherwise stated, for the private, exclusive use of our group. If the itinerary includes travel by train, we occupy first-class non-smoking compartments unless otherwise stated or available. Occasionally, travel by taxi or other public conveyance will be necessary for tour events. Group transportation is arranged for the specific activities listed on the final itinerary, and may not be used for personal purposes.

Air
Morgan Tours will make flight arrangements if requested. Unless otherwise stated, airline seating is the best economy-class available at the time of booking the tour. Ticket costs are paid by the client (directly to a credit card) at the time of confirmation (Net cost plus $50 per person). Individual airline policies apply. Morgan Tours cannot influence exchanges, refunds or cancellations. First-class and Business-class seating may be booked for a supplementary fee (reflecting airline's pricing structures) and are subject to availability by the airline. Requests to use air mileage plans should be made directly to the airline by the client. Morgan Tours has no control over the acceptance of an air mileage application or over any "black-out" periods. Non-acceptance of an air mileage application is not a valid reason for tour cancellation.

Seat selection will be made on the client's behalf as a courtesy, if requested, at the time of booking if this is allowed by the respective airline. If an airline cannot do this, the tour member must confirm his/her own seating (early check-in usually assures a good seat), unless the specific air arrangements are included in the tour costs. Seat assignment is not guaranteed until a boarding card is issued. Morgan Tours is not responsible for changes to seat assignment. Special services such as meal replacement or seating for medical reasons must be requested upon booking.

Water
Shipboard accommodation, as applicable, is specifically detailed in the individual tour itinerary as listed in the Destinations Planner or on our Web Site. Any cabin location may be booked, subject to availability. Tour costs will be adjusted accordingly.

Smoking Policy

Morgan Tours coaches are non-smoking. Arranged group activities should be considered non-smoking, indoors or not. These include meals, receptions, sightseeing tours, museum visits and other activities listed in the itinerary.

Smokers are welcome to join a tour subject to the above policy. Some airlines, trains, restaurants, etc., have designated smoking areas, and these will be made available to you upon request. For the purposes of group reservations, it is assumed that all tour members are non-smokers, unless they have indicated otherwise.

Weapons

Firearms, knives and other weapons are not permitted on our tours, no matter what documentation is provided.

Tour Directors

Each Morgan Tours program is accompanied by a qualified, experienced Tour Director who manages the details of the tour itinerary and looks after the safety and well-being of tour participants. The Tour Director will meet the members at the hotel of the first destination, and will remain with the group until the completion of the tour.

Gratuities

Tips and gratuities to all persons contracted to serve the group are included in the tour costs, unless specifically stated other wise. This includes the services of restaurant staff, hotel staff, guides and the like. In the case of our coach drivers, if warranted, a voluntary collection is made to express our gratitude for their dedication. Gratuities for Tour Directors are at each person's discretion. Gratuities and tips for services ordered by individual tour members are not included in their tour costs.

Customs Requirements

Documents
The individual is responsible for having a valid Passport and any other required Citizenship documentation, permit or status, as required to complete the tour itinerary. Morgan Tours will assist in application for the documentation required by providing forms, Embassy or Consulate contact information, and/or information on service agencies who can provide this type of assistance. Morgan Tours has no influence over the time required for processing or the acceptance of the applicant's request.

If Visas are required for a tour, members will be notified as they register. Supplementary charges for visa applications will be detailed at the same time. It is the responsibility of each tour member to obtain any required Visa or other travel document. Morgan Tours will assist where possible, but has no influence over the processing time required, cost, approval or other consideration of the issuing agent.

Medications
A tour member should check with his/her family doctor about inoculations, vaccinations or medications required to complete the itinerary. If there are any unusual requirements in this regard, they will be communicated to tour members upon registration. Any medical prescriptions or procedures required for travel are the tour member's responsibility and are not included in the tour costs.

For Customs and Immigration purposes, we recommend that all prescription medications be carried in their original containers, showing the pharmacy label. Be aware that Customs and Immigration officials throughout the world have a zero tolerance, no-excuses approach to illegal drugs.

Miscellaneous
Customs and Immigration laws usually require that computers, cameras, CD players and similar property be registered before departure from home. Individuals should obtain these documents before tour departure date, if not available at their respective departure point.

We recommend that all credit card and traveler's cheque numbers, passports, visas, citizenship documentation, and medical prescriptions and insurance, including telephone numbers necessary to obtain replacements, should be copied for reference and carried separately from the originals.
